The Office of the Public Guardian (OPG) has applied to the courts to suspend the powers of both PRC Cheat Yang Yin and the neice, Mdm HEdy Mok,’s powers over MDm Chung’s assets.
Previously, Mdm Chung had filed papers with the OPG to revoke Yang Yin’s Lasting Power of Attorney over her assets and Mdm Hedy mok had started court proceedings to do the same as well as getting damages from Yang Yin.
However, in an unexpected twist, the OPG is moving to suspend both Mdm Mok and Yang’s control.
Mr Yang’s lawyers explained that their client “welcomes and supports” the application made by the OPG which is expected to be heard on October 3.
If the application is approved, neither Yang nor Mdm Mok will be able to represent Mdm Chung in decisions regarding her assets.
The OPG explained that they took these steps because they need to protect Mdm Chung and her assets. The move will see a temporary suspension and they can make a more informed decision on what to do after the courts have made a determination on Mdm Chung’s mental capacity.
What will happen if the application is approved, is that Mdm Chung will be temporarily returned the only control of her assets and a medical expert appointed by the court will be asked to independently assess her mental capacity.
Following the medical report, it will be determined whether or not she can revoke Yang’s LPA which she gave him in 2012.
Similarly, Mdm Hedy Mok was appointed Mdm Chung’s deputy on Aug 1st in order to bring court proceedings against Yang Yin. The medical report will determine if Mdm Chung has the mental capacity to make decisions regarding this issue too.
So far, the OPG has also lodged a police report against Yang Yin for suspected abuse of Mdm Chung’s wealth after evidence of him leading lavish lifestyles emerged online.
